GUIDELINE FOR DISPOSING CERTIFICATE OF PERMIT FOR SINKING OF NEW TUBE WELLS FOR EXTRACTING GROUND WATER THROUGH SINGLE WINDOW CLEARANCE SYSTEM OF COMMERCE & INDUSTRIES
An Act titled'The West Bengal Ground Water Resources (Management, Control & Regulation) Act, 2005 (West Bengal Act XVIII of 2005) was enacted andThe West Bengal Ground Water Resources (Management, Control & Regulation) Rules, 2006' thereof was finalized and came into force with effect from 1st August, 2006 for proper utilization of ground water resources through effective management and regulation in West Bengal.
Authorities:
Two tier Authority has been set up by the State Government for implementation of this Act.
- District Level Groundwater Resources Development Authority (DLA)
- State Level Groundwater Resources Development Authority (SLA)
- Corporation Level Groundwater Resources Development Authority (CLA)
- High Level Groundwater Resources Development Authority (HLA).Only for Industrial Purpose.
Notification:
- There are 19(nineteen) District level Authorities for 19 districts of the State.
- One Corporation Level Authority for Kolkata Municipal Corporation and State level Authority as an Apex Body. As per provision of the Act it has been made mandatory to obtain permit from the concerned authorities for use of ground water through sinking of any kind of well / tube-wells.
- The District Level Authority shall, in case of an application relating to extraction or use of ground water at the rate not exceeding 50 cubic meter per hour for industrial purpose subject to sub-section (3)(a) above,issue permit within 30(thirty) days from the date of receipt of application.
- In case of an application relating to extraction or use of ground water at the rate exceeding 50 cubic meter per hour for industrial purpose, the District Level Authority shall, within 30(thirty) days from the date of receipt of application,forward the same to the State Level Authority with specific comment(s) or recommendation.
- The Corporation Level Authority shall, in cases of an application relating to extraction or use of ground water at the rate not exceeding 100 cubic meter per hour for industrial purpose subject to sub-section (4)(a) above, issue permit within 30(thirty) days from the date of receipt of application.
- In cases of an application relating to extraction or use of ground water at the rate exceeding 100 cubic meter per hour for industrial purpose, the Corporation Level Authority shall, within 30(thirty) days from the date of receipt of application, forward the same to the State Level Authority with specific comment(s) or recommendation.
- Provided that the State Level Authority shall, in case of an application for extraction or use of ground water for industrial purpose, within 21 (twenty- one) days from the date of receipt of such application from the District Level Authority or the Corporation Level Authority, as the case may be, subject to sub-section (5)(a) above, dispose of the same.
- In cases of extraction and use of ground water at the rate exceeding 100 cubic meter per hour for industrial purpose, the State Level Authority shall, within 21 (twenty-one) days from the date of receipt of application from the District Level Authority or the Corporation Level Authority, as the case may be, forward the same with specific comment(s) or recommendation to the High Level Authority.
- Every application for extraction or use of ground water resources for industrial purpose at the rate exceeding 100 cubic meter per hour, shall be forwarded to the High Level Authority by the State Level Authority with specific comment(s) or recommendation along with the observations or comments of the District Level Authority. Application for extraction or use of ground water at the rate exceeding 100 cubic meter per hour, shall be disposed of by the High Level Authority within 15(fifteen) days from the date receipt of the same from the State Level Authority.

STEPS FOR OBTAINING THE PERMIT IN ACCORDANCE TO THE GROUND WATER ACT 2005
GUIDELINES TO THE APPLICANT FOR GETTING PERMIT FOR ABSTRACTING GROUND WATER IN WEST BENGAL THROUGH SINGLE WINDOW CLEARANCE SYSTEM FOR MEDIUM TO LARGE SCALE INDUSTRIES:
- Register and Log In : Applicants have to register themselves in the single window site by creating a unique identity with password, with the help of which they will be able to enter the website.
- e-Filing of Application : Applicant can submit application in Form-I by opening the forms and submitting relevant information in the boxes through Single Window Clearance System along with the requisite documents (Annexure-A) and prescribed fee (Annexure-B). Time line for various activities to act upon the application is given in Annexure-C.
- Deposit of Fees: The Application fee (as per annexure B) has to be paid in Government Head of Account “0702-80-800-OTHER RECEIPTS-002-Other Items – 27-Other Receipts”(CODE 0702-80-002-27).The application fee referred to in sub-rule (1) shall be paid by Challan to the Treasury link bank or the Reserve Bank of India or any duly authorised Public Sector Undertaking Bank under the Head of A/C "0702-80-800-OTHER RECEIPTS-002-Other Items-27-Other Receipts" (Code : 0702-80-800-002-27). Applicant have to attach the scanned copy of the Treasury Challan.
- Uploading required Documents (see Annexure-A):
- For submitting supporting documents, applicant should keep the scanned copy of the required documents (as per Annexure-A) ready in their computer before they go for e-filing of application. Such scanned copies should be in ‘pdf’ or ‘jpeg’ or ‘gif’ format. Total maximum digital size of all the pdf/jpeg/gif documents to be uploaded should not exceed 2 MB).
- If some large documents (like large maps) cannot be scanned and copied in ‘pdf’ or ‘jpeg’ or ‘gif’ format, there will be no alternative but to submit the ‘hard’ copy of the same to the office of the concerned Geologist by special messenger, or by Speed Post. Applicant have to write your unique ID, generated at the time of accessing the Single Window website, and the date of submitting online application should be written on the body of the document. The envelope should be super-scribed with the words written in bold letters, “SUPPORTING DOCUMENTS FOR ONLINE APPLICATION MADE ON __________ ".
- The complete filled up application (Form-1) would be submitted and communicated to the Geologist & Member Secretary, District Level Ground Water Resources Development Authority (DLGWRDA) of the concerned District through Single Window System. The Geologist of the concerned District will communicate with the Chairman & District Magistrate, DLA of the respective District, the Member Secretary, SLA & the Chairman, SLA and accordingly internal communication will be made for processing of the submitted application.
- Geologist & Member Secretary, DLGWRDA will have to inform immediately as soon as application submitted for Single Window Clearance on line to the Chairman & District Magistrate, DLA of the respective District, the Member Secretary, SLA & the Chairman, SLA. The concern Geologist will prepare the inspection report and submit to the DLGWRDA within 21 days and the same will have to be processed in Monthly meeting of DLGWRDA. The Geologist & Member Secretary, DLGWRDA will be in close vigil in case to case basis with the Chairman & District Magistrate, DLA of the respective District, the Member Secretary, SLA & the Chairman, SLA upto final approval/decision.
- Superintending Geologist & Member Secretary, SLGWRDA will submit to the SLGWRDA within 15 days and the same will have to be processed in Bi-Monthly meeting of SLGWRDA.
- The application will be placed to the High Level Inter Departmental Committee A or B which will take 15 days maximum to take decision.
- As soon as clearance is obtained from HLIDC, intimation in Form 2 will be given by the Member Secretary, DLGWRDA within next 3 working days with the instruction to submit Form 3 with requisite fee within 30 days.
- If Form-3 with TR-7 (with requisite fees through Challan) is received by the concern Geologist & Member Secretary, DLGWRDA, Form-4 (Certificate of Permit) will be kept ready for handed over to the applicant and side by side uploaded on the web-site. The hard copy of the “Certificate of Permit’ will be collected from the office of the Geologist & Member Secretary of the District.
- If rejected, Form-5 will have to be issued by the concern Geologist & Member Secretary, DLGWRDA immediately.
- All the cases, update of status or notification will be done by the Geologist & Member Secretary, DLGWRDA. The nodal officer at the State Head Quarter will monitor the whole process of disposal of applications, uploading the status by different District Level officers and also co-ordinate with the Task Force, headed by the Director of Industries.
Annexure-A: Requisite documents to be submitted along with the application (Form-1).
- Proof of ownership of land.
- Land conversion document.
- Registered Power of Attorney in favour of the applicant, in case of the plot of land where the proposed well is to be constructed belongs to more than one persons.
- Photo ID proof of the concern authority of the Industry.
- PAN card issued in favour of the Industry.
- Detail Project Report mentioning water demand, proposed volume of ground water to be withdrawn, volume of water expected to be supplied by pipe water/surface water to meet out requirement.
- Proposals for water conservation structure, waste water treatment plant if any.
- Mouza Map showing location of the proposed well.
- If required, EIA (Environmental Impact Assessment) Report / Hydrogeological Report.
- Environmental Clearance.
- Trade Licence from concerned authority.
- Chemical test report of the nearby tube well/s mentioning depth of the well, strainer position, diameter, date of sample collection, date of analysis etc. from BIS approved Lab.
- Registration related documents of the Industry.
- Scanned copy of the Challan of the Treasury link bank/RBI/ any dully authorized public sector undertaking bank.

Fee for Appeal:
A user may prefer an appeal to the appellate authority under the Act on payment of such fee as specified in column (3) of Table below, on the basis of category of discharge range of the well as mentioned in column (2) of the said Table :—

GUIDELINES FOR THE DISTRICT LEVEL (MEMBER SECRETARY & GEOLOGISTS) /CIRCLE LEVEL OFFICERS:
- The Geologist have to log in through their Login ID and password which is already communicated.
- Geologist & Member Secretary, DLGWRDA will have to inform immediately as soon as application submitted for Single Window Clearance on line to the Chairman & District Magistrate, DLA of the respective District, the Member Secretary, SLA & the Chairman, SLA. The concern Geologist will prepare the inspection report and submit to the DLGWRDA within 21 days and the same will have to be processed in Monthly meeting of DLGWRDA. The Geologist & Member Secretary, DLGWRDA will be in close vigil in case to case basis with the Chairman & District Magistrate, DLA of the respective District, the Member Secretary, SLA & the Chairman, SLA upto final approval/decision.
